These terms govern your use of farmrix.com and the Farmrix application. By creating an account or using the service you agree to them.
Farmrix is a software platform for real estate professionals. It scores property owners by likelihood to sell, builds targeted mailing lists, prints and mails campaigns on your behalf, and tracks the responses those campaigns generate. Features may change over time as we improve the product.
You must provide accurate information when you register and keep it current. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us right away at hello@farmrix.com if you believe your account has been compromised. You must be at least 18 years old and using the service for business purposes.
Farmrix is sold as a monthly subscription. Plans are billed in advance each month through our payment processor. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period and you keep access until then. Plan credits, including mail and data credits, refresh monthly and do not roll over unless your plan explicitly says otherwise. If we change pricing for your plan we will give you notice before the change applies to your next billing period. Except where required by law, payments are non-refundable.
You agree to use Farmrix lawfully and to keep your outreach to property owners respectful and honest. In particular, you will not:
Compliance with direct mail is shared. Farmrix is responsible for postal formatting, printing quality, and lawful handling of the data we supply. You are responsible for the content of your message and for complying with the laws that apply to your outreach, including any state licensing, advertising, and solicitation rules that govern your business, and for honoring opt-out requests you receive from recipients. Farmrix provides suppression tools to help you honor those requests.
Farmrix owns the platform, including its software, scoring models, designs, and templates. We grant you a limited, non-exclusive, non-transferable license to use them within the service while your subscription is active. You own the content you create, such as your campaign copy, and you grant us the limited rights needed to print, mail, and display it in order to run your campaigns.
The service is provided as is and as available. Property data comes from public records and third-party providers and, while we work to keep it accurate, we cannot guarantee it is complete, current, or error-free. Results vary. Farmrix makes no guarantee that using the service will produce responses, appointments, deals, or revenue. Direct mail outcomes depend on your market, your offer, your follow-up, and factors outside our control.
To the maximum extent permitted by law, Farmrix will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business opportunities, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amounts you paid to Farmrix in the twelve months before the event giving rise to the claim.
You may stop using the service and cancel your subscription at any time. We may suspend or terminate your account if you materially violate these terms, misuse owner data, or use the service in a way that creates risk or legal exposure for Farmrix or others. Where practical we will notify you and give you a chance to fix the issue first. Sections that by their nature should survive termination, including intellectual property, disclaimers, and limitation of liability, will survive.
These terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Georgia, and both parties consent to their jurisdiction.
We may update these terms from time to time. If a change is material we will notify account holders by email or in the application before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.
